Background: Pursuant to a Farmer's Market Agreement, the Enderis Park Neighborhood Association ("EPNA") will sponsor a neighborhood farmer's market at Enderis Playfield to provide patrons access to locally grown fruits and vegetables while offering a point of connection between neighbors and their local growers and food producers. As part of this agreement, the Administration is requesting a waiver of Administrative Policy 5.02(3)(a)(2)(e), which prohibits permit holders from earning a commercial or personal profit as a result of their use of MPS facilities. The farmer's market will be free and open to all members of the public; however, the local vendors, who will be selling fresh fruits, vegetables, baked goods, etc., will pay the EPNA a fee to participate in the market. EPNA uses vendor fees to cover its MPS permit fee, the costs of a field attendant, additional trash removal, if needed, and any permits required by the City of Milwaukee to host such an event.

The Farmer's Market Agreement will run from May 1, 2017, through September 30, 2017, with contemplated annual renewals. The total cost to MPS will be zero, as all costs will be reimbursed by the EPNA.

The EPNA has offered to serve as a resource for other neighborhood groups throughout the City of Milwaukee who wish to start similar markets. It is the hope of Administration that similar requests will come to the Board for review in the future.
Fiscal Impact Statement: This item does not authorize expenditures.
Implementation and Assessment Plan Upon approval by the Board, the Farmer's Market Agreement will begin as indicated in the attachment.
Recommendation: Your Committee recommends that the Board authorize a waiver of Administrative Policy 5.02(3)(a)(2)(e) to allow the Enderis Park Neighborhood Association to sponsor a summer farmers market at Enderis Playfield.
