Background: As part of the original freeway expansion project adjacent to Lancaster School, a portion of the alley in the block bounded by West Fond du Lac Avenue, West Lancaster Avenue, North 68th Street, and North 69th Street was formally vacated as a public right-of-way. In February 2020, the Board approved a Lis Pendens and Petition to Vacate which authorized the City of Milwaukee Common Council to approve of the remaining portion of the alley to be vacated as a public-right-of-way.

The City of Milwaukee Common Council approved of the Lis Pendens and Petition to Vacate on May 27, 2020. The administration is requesting authorization to work with the City of Milwaukee to approve of the attached Quit Claim Deed - State Grantor in order to acquire the portion of the alley that was allocated to the Wisconsin Department of Transportation after the City of Milwaukee’s vacation of the alley. This will allow the District to make better use of the site as part of the planned parking lot reconstruction project at Lancaster School.

The Administratioin recommends is that the Board approve the request to approve the acquisition of the portion of the northwest-southeast alley directly adjacent to Lancaster School that was allocated to the Wisconsin Department of Transportation after the City of Milwaukee’s vacation of the alley in order to make better use of the site as part of the planned parking lot reconstruction project.
Fiscal Impact Statement: There are no expenditures associated with this item.
Implementation and Assessment Plan Upon Board approval, the Administration will work with the City of Milwaukee to acquire the portion of vacated alley from the State of Wisconsin.
